I have seen this waiver and others like it circulating through social media. While it looks harmless at first glance, there is no need for school districts to have a signed consent for teletherapy services! IDEA waivers were not granted to school districts, so districts still have to follow all the same requirements regarding IEP’s and services. This waiver in particular brings up that there are benefits to telehealth, but that results can’t be guaranteed or assured. The school district is still required to ensure students make meaningful progress in their education, and if they aren’t, FAPE isn’t being provided. Service delivery has always been, and will continue to be, an IEP team decision. And, if your child isn’t making progress, there are steps your IEP team should take to remedy that situation.
